01 Acceptance of Terms
By installing, accessing, or using Premium Tracker (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Service.
These Terms apply to all users of Premium Tracker, including free tier and premium tier users. You must be at least 18 years old to use the Service.
02 Description of Service
Premium Tracker is a Google Workspace™ add-on that helps retail options traders track covered call and cash-secured put premium income. The Service includes:
- Free Tier: A pre-built Google Sheets™ spreadsheet with manual trade entry, automatic P&L calculation, multi-dimensional trade scoring (A–F), weekly and monthly income summaries, and a dashboard.
- Premium Tier (coming soon): Automatic transaction sync from E*TRADE™ via OAuth, automatic position grouping, stock price capture, and expiration detection.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
03 Account Registration
Access to the free tier requires only a Google account. Premium tier (when available) will require registration with a valid email address and payment information.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account at nealm682@gmail.com.
You agree to provide accurate, current, and complete information and to keep your account information updated.
04 License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Premium Tracker for your personal, non-commercial use.
This license does not include the right to:
- Copy, modify, or distribute the add-on or its source code
- Reverse engineer or attempt to extract source code
- Resell, sublicense, or transfer your access to the Service
- Use the Service on behalf of others as a service bureau
05 Subscriptions & Billing
Free Tier: The free tier is available at no cost and includes all features described in Section 2 under Free Tier. We reserve the right to change what is included in the free tier with 30 days' notice.
Premium Tier (coming soon): When premium launches, the following terms will apply:
- Subscriptions are billed monthly or annually in advance.
- Subscriptions automatically renew unless cancelled before the renewal date.
- Payments are processed by Stripe. We do not store your payment card information.
- No refunds are issued for partial subscription periods or unused features.
- If a payment fails, your account will be downgraded to the free tier after a grace period.
- Prices may change with 30 days' advance notice to active subscribers.
06 Acceptable Use & Restrictions
You agree not to use the Service to:
- Violate any applicable law or regulation
- Transmit harmful, fraudulent, or deceptive content
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorized access to any part of the Service
- Use automated tools to scrape, crawl, or overload the Service
- Impersonate any person or entity
We reserve the right to suspend or terminate accounts that violate these restrictions without notice.
07 No Financial Advice
Important: Premium Tracker is a record-keeping and analysis tool only. Nothing in the Service constitutes financial, investment, tax, or legal advice. Trade grades, scores, income projections, and other outputs are for informational purposes only and do not constitute recommendations to buy, sell, or hold any security.
Options trading involves substantial risk of loss. Past performance of any trading strategy is not indicative of future results. You are solely responsible for your trading decisions. Always consult a qualified financial advisor before making investment decisions.
We are not registered as an investment advisor, broker-dealer, or financial planner with any regulatory authority.
08 Intellectual Property
Premium Tracker, including its source code, design, algorithms, scoring methodology, and all associated content, is owned by us or our licensors and is protected by copyright, trade secret, and other intellectual property laws.
Your trade data entered into the Service belongs to you. We claim no ownership over your data.
By submitting feedback or suggestions, you grant us a royalty-free license to use that feedback to improve the Service.
09 Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
Our total cumulative liability for any claims arising from your use of the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
10 Indemnification
You agree to indemnify, defend, and hold harmless Premium Tracker and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another party.
11 Termination
You may stop using the Service at any time by uninstalling the add-on from Google Sheets.
We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your license to use the Service immediately ends. Your trade data remains in your Google Sheet and is unaffected by termination.
12 Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date and, where appropriate, by notification within the add-on or by email. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
13 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
